Terms and conditions
The general conditions apply to all agreements on www.MTimpex.com

Identity of the company
Mobile Today BV trading under the name MT Import & Export and www.MTimpex.com.
Mobile Today BV is not a proprietor and also maintain no relationship with official brand owners. However, MT Mobile Today has its own brand (MT) registered at the Benelux Office for Intellectual Property (BOIP). Unauthorized use can have legal consequences for the unlawful user.

Article 1. Applicability
These Terms and Conditions apply to all offers, orders and agreements made on MTimpex.com.
Accepting an offer or placing an order means that you accept the applicability of these conditions.
Deviation from provisions in these Conditions may only take place after written or electronic notice to or written or electronic approval to deviate from MTimpex.com, in which case the other provisions remain in effect.
All rights and claims, as in these conditions, and as are stipulated in any further agreements for MTimpex.com, are also stipulated by MTimpex.com intermediaries and other third parties.  
To see the prices on MTimpex.com you must first register and send your company license number by e-mail to MTimpex.com. For customers abroad, this is the VAT number.

Article 2. Offers / agreements
All offers are free and MTimpex.com expressly reserves the right to change the prices, especially when necessary on the basis of (legal) regulations.

The offers on MTimpex.com are not applicable to the establishment of MTimpex.com! These are deals that are offered on www.MTimpex.com and delivered by courier to the customer.  All offers last as long as there is stock.

An agreement is only after acceptance of your order by MTimpex.com. MTimpex.com is entitled to refuse orders or attach certain conditions to the delivery, unless otherwise specified. If an order is not accepted, MTimpex.com may communicate in writing or electronically to the receipt of the order.

Article 3. Prices and Payments
The listed prices for the products www.MTimpex.com are in Euros, excluding VAT, unless otherwise stated or agreed in writing.

MTimpex.com offers different payment options.

• Prepayment: You can prepay by transfering the amount directly to the bank account of MTimpex.com. Your order will be delivered after your payment is received by MTimpex.com.
• COD: COD costs amount to € 18,09 per package. You can in this case pay the amount to the postman. The costs for cash on delivery may vary / upper hatch depending on the order (total amount).
• Paypal: safe and international way of electronic payment
• iDeal: fast and safe way of electronic payment 
• Payment on invoice: this is only possible if there is an agreement with MTimpex.com

If the prices of the products offered increase in the period between the order and its execution, you are entitled to cancel the order or dissolve the agreement within ten (10) days after notice of the increase by MTimpex.com.

Article 4. Delivery
If the force majeure lasts longer than 30 days, both MTimpex.com and the buyer have the possibility to dissolve the agreement in writing, after which the two parties are exempt from their obligations to each other and any payments already made will be refunded.
The delivery times specified by MTimpex.com are only indicative. Late delivery does not entitle you to compensation.
The delivery of the products will take place when the products are ready for shipment to you.
MTimpex.com is entitled to deliver the goods to in stages.

When a ready-made order is transferred to the courier company, the buyer is obliged to comply with its payment within the prescribed period. Shipped orders are not reversed, unless they are covered by the return and warranty terms of MTimpex.com.

Orders over € 199,- (excl.taxes) are shipped free within Europe. This does not apply when an order is as cash on delivery. The cost of cash on delivery is € 18,09 per package.

MTimpex.com is within its rights to process orders differently per case. Orders under € 50,- (excl.taxes) may be refused without giving reasons. If your orders are more than twice as small as € 50, then your order can be canceled.

Delivery time:
MTimpex.com strives to deliver orders within the Europe within 24 hours when the order before 19.00hrs are placed

No orders are being prepared in the weekend. If you place an order on Friday, it will be processed on Monday.
Some products can be supplied in connection with supply in limited quantities. MTimpex.com is entitled to deliver in limited quantities of products to customers and limited or businesses.

For orders from abroad, you must disclose your VAT number to us electronically or by mail. The shipping costs for overseas are based on weight of the order and the country where the order must be shipped to.

Orders with battery can have a delivery time of 48 hours.

Article 4a. Return

In case an order is sent wrong (wrong or defective products, order not complete) by MTimpex.com, the buyer must notify MTimpex.com in writing or electronically within three (3) days after the receipt of the goods. If a return is not received correctly then MTimpex.com will notify to the purchaser *.
Returned products must be returned unused in the original packaging. The buyer is responsible for the costs and the correct (undamaged product / packaging) return of the products to MTimpex.com. After receipt, returned products are shipped to the manufacturer/technical department for investigation. After the replacement of the products by the manufacturer, the products will be return to the buyer if the products are covered by the warranty terms of MTimpex.com.

In all cases, it is necessary to take into account a time period of 4 weeks to process and evaluate the return. Upon the return of goods to MTimpex.com, the following actions can be undertaken by MTimpex.com.

• The product is under warranty and will be replaced
• The product is under warranty, but can not be replaced because it is out of stock. In this case a credite note will be made and the amount of the credit note will be deposited into the bank account of the buyer within 14 days.
  
• The product is not covered by warranty and is returned to the customer.

If the buyer has placed an order but the package is not received on time, then the buyer must notify MTimpex.com within seven (7) days. If the fault lies with MTimpex.com in case of a return, then MTimpex.com is also responsible for the cost of return.

Products must be returned within 30 days after the purchase date. Returns filed 30 days after the purchase date have expired and will not be accepted.

Returned products are replaced (if they fall under warrenty) only if they are in stock. If that is not the case a credit invoice will be created for the amount that should be refunded to the account of the buyer. The amount of the credit note can not be deducted from a next order.

If a returned package is not received by MTimpex.com for any reason whatsoever,  MTimpex.com bears no responsibility for that. However, you are advised to send your return by registered mail to MTimpex.com.

The customer must indicate clearly what exactly is wrong with a returned product. This can be done by means of a sticker or a note when you return product (s).

Returns  which due the lack of enclosed information are unclear regarding to whom they belong and what the return reason is, will expire after three months in case no further information is eclosed by the buyer.

Digital return forms submitted expire after 14 days if the products are not returned on time (within 14 days) to MTimpex.com. If the buyer wish to still return the products, then a new digital return form must be submitted. 

Article 5. Warranty
MTimpex.com will provide warranty on the products that that meet the contract specifications stated in the offer, the reasonable requirements of reliability and/or usability and on the date of the conclusion of the agreement existing legal provisions and/or government regulations. If agreed, MTimpex.com also ensures that the product is suitable for other than normal use.
Products to which the guarantee applies will only be exchanged.
For LCD displays and touch applies: if the LCD displays are deliverd defective/damaged to the buyer, the buyer must notify MTimpex.com within three (3) days  in writing or electronically.

LCD displays and touch can only be exchanged if they are in original packaging and with MT sticker and factory sticker, with which they are delivered.

All LCD & Touch from Samsung are not covered by our warranty.

MT Import & Export offers warranty on the following products:
- Battery: 1 year warranty
- MT Thuislader new 1 year warranty
- MT Thuislader: 1 year warranty
- MT USB Car Charger: 1 year warranty
- MT Car Charger: 1 year warranty
- Memory cards: 5 years warranty
- Telephones: only manufacturer  warranty (New 1 Year standard and Used 2 months)

Article 6. Property reservation

The ownership of products is transferred only if you already have paid that what your owe onder any agreement with MTimpex.com. The risk in respect of the products will be transferrd to you at the time of delivery.

Article 7. Intellectual and industrial property
You are deemed to fully respect all intellectual and industrial property rights that apply to the delivered products, unconditionally.
IPod, IPhone, IPad and Mac are trademarks Inc. and are used for compatibility purposes only.

Article 8. Complaints and liability
You have the obligation to examine the delivery to find out whether the products meet the agreement. If this is not the case, you should notify MTimpex.com as soon as possible, within three (3) days of delivery.

Article 9. Orders / communication
For misunderstanding, delays or improper transmission of order data and messages resulting from the use of Internet or other communication between you and MTimpex.com or between MTimpex.com and others, as it relates to the relationship between you and MTimpex.com, MTimpex.com is not liable, except to the extent where there might be intentional or gross negligence by MTimpex.com.

Article 10. Personal
MTimpex.com adheres to the Data Protection Registration Act. The data provided will be included in a file. MTimpex.com respects the privacy of all users of its site and ensures that personal information is treated confidentially. This data will be used to process orders as quickly and easily as possible. The personal information will never be made available to third parties that are not affiliated with MTimpex.com except; when there is infringement of copyrights of MTimpex.com or when there is a legal offense. In the cases mentioned MTimpex.comis  authorized to hand over your information to the responsible authorities.

* Article 11. Force Majeure
Without prejudice to its other rights, MTimpex.com in case of force majeure holds the right regarding the execution of your order, to suspend or terminate the agreement without judicial intervention, by informing you in writing MTimpex.com and without being liable for any compensation, unless this would be unacceptable in the circumstances to standards of reasonableness and fairness.

* Force majeure is defined as any failure that can not be attributed to MTimpex.com because it is not due to its fault and not under the law, legal act or generally accepted traffic for its account.

Article 12. Copyright to material / Copyright

Mobile Today B.V. the owner of www.MTimpex.com holds the copyright to all the images on its website. Mobile Today B.V. is the creator and thus the rightful owner of the material.

It is not allowed to footage without permission MTimpex.com, for any purpose whatsoever, download, copy or use.

In case of a violation or breach of the above copyright Mobile Today B.V. is in its rights to use all  legal means at its disposal to prosecute the violator(s) legally.

Article 13. Miscellaneous
When you provide (in writing or electronically) MTimpex.com with an adress to which the goods must be sent, MTimpex.com is entiteld to send the goods to that adress, unless you provide with a different adress. The adress must belong to you or to one of your establishments as a buyer. MTimpex.com does NOT do dropshipping.

Deviation by MTimpex.com from these conditions for any period of time will not prejudice its right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any right by virtue of the fact that MTimpex.com applies these conditions smoothly.

If one or more provisions of these Terms or any other agreement with MTimpex.com is in conflict with any laws, the provision will overruled by a new provision as provided by MTimpex.com
Regarding the execution of your orders (s), MTimpex.com is authorized to use third parties.

Article 14. Governing Law and Jurisdiction
All rights, obligations, offers, orders and agreements to which these Conditions apply, as to these conditions, only Dutch law is applicable.
All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
